A Georgia self-storage owner has lost his battle in court over the use of sewerage lines on the site he owns.
Les Coffey, owner of Peerless Self Storage and the Peerless Mills site, filed a civil suit against the city of Rossville, claiming the city owes him $985,000 for using sewerage lines on the Peerless Mills site, where hes built a self-storage facility.
In a 52-page summary issued Thursday in the U.S. District Court in Rome, Ga., Federal Judge Harold Murphy said the city has an express easement of the sewer lines. The ruling took into consideration a 1958 deed and easement between Burlington Industries, a textile manufacturer, and the city, and another deed with Rossville Development Court Inc. (RDC), which sold the property to Coffey for $1.3 million in 2007. RDC still holds the lien. Coffey spent another $800,000 retrofitting the property into self-storage.
Coffey has had ongoing disputes with the city, and was arrested Feb. 16 after he threatened to pour concrete into the sewerage lines to block the citys use.
In February, he obtained a permit from the city to demolish the buildings. He plans to turn the property into a metal-recycling scrap yard. RDC has filed a court injunction to block the demolition plans.
