Utah Amends Procedure for Self-Storage Legal Notices

Article-Utah Amends Procedure for Self-Storage Legal Notices

Legislators in the state of Utah have amended state law that affects the publication of legal notices for self-storage.

Legislators in the state of Utah have amended state law that affects the publication of legal notices for self-storage. The state has established a website, www.utahlegals.com, as well as a new time table and other requirements for the publishing of legal notices, such as those posted by self-storage operators in relation to lien sales. The website is operated by a consortium of Utah newspapers.

Per the amended law, SB 0208, public notices will have to be posted in the newspaper and on the established website beginning Jan. 1, 2010. However, owners of storage facilities in the biggest counties (first and second class) must publish notices on the website but are not required to publish in the newspaper. Online notices are free of charge until Jan. 1, 2012, after which the charge cannot exceed $10.

Legislators have agreed to fix an error in the fourth amendment of the bill that requires all self-storage facilities to post their advertisement "in not less than six conspicuous places in the neighborhood where the self-service storage facility is located.”
